CLE Training: Ethical Representation: Serving Clients with Criminal Contacts

Contact with the criminal legal system can create unique risks and complications for an immigrant client. The Immigrant Defense Project Helpline provides individualized analysis of the effect of any contact with the criminal legal system on a person’s immigration status, and gives clear, accurate, individualized advice to legal service providers by serving as crim-imm experts. This training is intended to provide information to attorneys, DOJ accredited representatives, and their support staff on how to provide competent and diligent representation to their clients by using IDP’s hotline. The training will explain how IDP’s experts can help attorneys meet their ethical duties to provide legal representation to clients who have had contact with police and the criminal legal system. It will also give best practices for how to use IDP’s services through the helpline.

  • The ethical duties that apply to client representation and how to fulfill these duties, even where you may not be a subject matter expert in criminal-immigration matters
  • The ethics of advising immigrant clients on the immigration consequences of criminal contact
  • The ethics and best practices for using IDP’s hotline to seek advice for an individual client

This course is designed for individuals representing immigrants in affirmative applications to USCIS, removal proceedings before EOIR, or providing legal advice for the purpose of any immigration issue.
