On September 6, 2023, the Second Circuit issued a landmark decision in U.S. v. Minter, No. 21-3102, 2023 WL 5730084 (2d Cir. Sept. 6, 2023), which held that certain New York “Narcotic Drug” Convictions are not Aggravated Felonies or Offenses Relating to a Controlled Substance. The decision in Minter opens up exciting paths for non-citizens who have New York “Narcotic Drug” convictions to reopen old deportation orders out of the Second Circuit. This course will review the Second Circuit’s holding in Minter, discuss who could benefit from the decision, and cover considerations and logistics around filing Motions to Reopen or Reconsider based on Minter.

- How to identify clients who could benefit from the decision
- The nuts and bolts of filing a Motion to Reopen or Reconsider and considerations around deciding to file a MTR in light of U.S. v. Minter
Who should attend:
Immigration attorneys and advocates representing clients who have New York State narcotics convictions and/or who have previously filed or are considering filing Motions to Reopen or Reconsider. This course assumes a basic knowledge of the Categorical Approach methodology. There will be a brief overview as part of the training but this is not an in-depth training on the Categorical Approach.
This course is not open to individuals employed by local, state, or federal law enforcement agencies, including the Department of Homeland Security or by prosecutorial agencies including District Attorney’s Offices.
Continuing Legal Education Credits:
IDP has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of Continuing Legal Education in the State of New York (2022–2025) in traditional and non-traditional formats. This transitional/non-transitional program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 1.5 credit hours in Areas of Professional Practice. No CLE credit may be earned for repeat attendance at any accredited CLE activity in a calendar year.
