Article 10 proceedings in New York State Family Court can create unique risks and complications for a noncitizen respondent. Actions taken in family court, such as admissions to non-citizen status, findings that the respondent has violated an order of protection, or findings of abuse and neglect, may lead directly to immigration consequences. This training is intended to provide introductory information to family defense attorneys on how to work with noncitizen clients and incorporate immigration concerns into their representation strategy. The training will explain the potential immigration consequences of adjudications in Article 10 proceedings. It will also give some best practices for how family defense counsel can try to avoid immigration consequences at different stages of an Article 10 case.

Who should attend:
Family Court attorneys and advocates representing respondents in Article 10 proceedings and related matters. This course is not open to individuals employed by Administration for Children’s Services, Child Protective Services, other child welfare agencies, local, state, or federal law enforcement agencies, including the Department of Homeland Security or by prosecutorial agencies including District Attorney’s Offices.
Continuing Legal Education Credits:
IDP has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of Continuing Legal Education in the State of New York (2022–2025) in traditional and non-traditional formats. This transitional/non-transitional program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 1 credit hours. No CLE credit may be earned for repeat attendance at any accredited CLE activity.
