In 2010, the Supreme Court held that the 6th Amendment requires criminal defense attorneys to advise non-citizen clients about the immigration consequences that could arise from the decision to plead guilty or go to trial in Padilla v. Kentucky. The training will provide guidance for defense attorneys on gathering immigration information from clients to work with immigration counsel to understand the immigration consequences of convictions. It will also include updates on current ICE arrest and policing practices in New York City.
The training is virtual and free of charge. It was last given for CLE credit on June 8, 2022. Advanced registration is required.

- Why it matters for defense counsel to advise immigrant clients on immigration consequences of criminal contact
- Current ICE arrest and policing practices in New York City (including at and around courthouses)
- A brief introduction to basic concepts of immigration law and the client history that impacts the immigration consequences of a conviction
- An overview of common immigration statuses
Who should attend:
Criminal defense or family defense attorneys who represent immigrant clients and want information about the best practices for gathering immigration history information and up-to-date information about the ways ICE targets immigrants after an arrest. This course is appropriate for both new and experienced attorneys. This course is not open to individuals employed by local, state, or federal law enforcement agencies, including the Department of Homeland Security or by prosecutorial agencies including District Attorney’s Offices.
Continuing Legal Education Credits:
IDP has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of Continuing Legal Education in the State of New York (2022–2025) in traditional and non-traditional formats. This transitional/non-transitional program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 1.5 credit hours. No CLE credit may be earned for repeat attendance at any accredited CLE activity.
