The Crimes and Immigration Seminar is an annual CLE program that provides in-depth training on key topics in criminal-immigration law practice. The seminar is designed to be useful and engaging for both introductory and advanced immigration law practitioners.
The first day will cover a variety of topics relating to the categorical approach, the analysis that courts use to determine the immigration consequences of criminal convictions. The opening session will provide attendees with an understanding of how the categorical approach is conducted in immigration cases, highlighting advanced topics and challenges that arise in practice. The second and third sessions focus on two in-depth topics related to the categorical approach: understanding the modified categorical approach following the Supreme Court’s 2021 decision in Pereida v Wilkinson, and an overview of advanced indivisibility arguments. The day will close with a discussion of recent and notable decisions in the Second and Third Circuits that may impact criminal-immigration practice.
The second day will focus on the impact of post-conviction relief for immigration purposes, including vacaturs, expungements, and sentence modifications in state criminal court. The first session will provide an overview of how to pursue post-conviction relief for your noncitizen client, and the second session will provide an in-depth discussion of how to get post-conviction relief to be recognized for immigration law purposes. Finally, the day will close with a session on motions to reopen that are based on successful post-conviction relief and particular challenges that may arise in this context.

The New York State Defenders Association (NYSDA) has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of Continuing Legal Education in the State of New York. This transitional/nontransitional program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 8 Professional Practice credits. No CLE credit may be earned for repeat attendance at any accredited CLE activity. Financial aid is available for attorneys who wish to attend but are experiencing financial hardship.
